1. GENERAL
1.1 Scope
This policy applies to all parties that may be involved in CMCS Mercenary contracting.
For any inquiries, please join our Discord Server where you will be granted Diplomat access.
1.2 CMCS Code of conduct
CMCS has built its reputation for honour, professionalism and integrity. These values distinguish us from less scrupulous mercenary companies.
- Honour CMCS operatives will conduct themselves honourably at all times
- Professionalism Each contract is subject to our high standards of conduct and expertise
- Integrity We are committed to transparency and honesty in the conduct of a contract and expect the same from our clients
- Loyalty Once a contract is active, our clients can be confident we will uphold our end of the deal and specifically not accept counter-offers
- Respect Our operations will be conducted with due respect for all parties involved
- Excellence We strive for the highest level of operational success and client satisfaction
CMCS Expertise lies in faction operations and faction warfare. However the full spectrum of our capabilities is much wider. We invite you to inquire for detailed information about the specific type of operation you might have in mind.
Explicit exclusions
- We do not track and hunt individual CMDRs
- We will not gank or grief under any circumstances
2. CONTRACT INITIATION
2.1 Planning
Contract initiation will preferably be discussed on Discord Server, where a potential client will be granted Diplomat rights and a private channel will be established. Discussion via Inara Private Messages is possible but might significantly delay contract initiation.
2.2 Scope of work
The Scope of Work shall be negotiated and established prior to contract execution and shall outline all objectives, payment terms, operational methods and timeline.
2.3 Due Diligence
Both parties shall conduct appropriate due diligence before entering the contract. This includes operation background, general faction situation, alliances and the ability to meet the terms of the agreement. Please note that CMCS will not consider contracts within our Local Exclusion Zone as defined in Faction Operations Domestic Policy
2.4 Good Faith Clause
Both parties agree to act in good faith during initiation and throughout the term of the contract. This includes transparent communication, honesty, and a collaborative effort to fulfill agreed upon objectives or resolve any issues that may arise.
3. COMPENSATION AND PAYMENT
3.1 Rate structure
CMCS uses a rate structure based on the number of participating members or CMDR-hour and tied to the effects being achieved. A contract will be divided into objective and/or effects, each of which shall be associated with an individual compensation. Specific rates will be negotiated on a case by case basis.
3.2 Incentives and bonuses
Optional objectives are typically tied to extra compensation to the participating members only.
3.3 Payment Timeline
- Payment is due upon completion of a contract for contracts of one week or less
- Payment is due upon objective completion for longer duration contracts
- Upfront payment prior to contract execution is typically not required
Payment shall be made via Fleet Carrier transfers.
4. CONTRACT EXECUTION
4.1 Rules of Engagement
CMCS will respect the rules of engagement set by the client during contract initiation. These include but are not limited to : Operational Security, Communication protocol, Approved activities, PvP.
In the absence of contractual restrictions, the following Rules of Engagement will be used by default:
- Overt OPS (Open) CMCS assumes the risks of being fired upon by a third party. We will use Fleet Carriers.
- Full Spectrum OPS We will not restrict any kind of activity
- Client identity on request We will answer to inquiries about the client and may put both parties in contact
- PvP Self-Defense We will not seek to engage Target associated players actively but will defend our assets if fired upon
CMCS prefers to engage in short-term contracts from a few days to a few weeks. Longer campaigns will be considered but are typically less effective, more costly and shall include renegotiation timelines.
4.3 Objectives
Objectives will be clearly defined and measurable. Progress and contribution towards each objective will be reported to client periodically using our proprietary tracking tool. CMCS reserves the right to provide advice on a strategic and tactical level, not only to achieve the desired objectives, but also to create long term sustainable effects.
5. CONTRACT TERMINATION
5.1 Completion
Contract will normally be terminated upon completion of all objectives.
5.2 Early Termination
Client Initiated termination
A contract may be terminated at anytime by the client. In this case, all payments for previously completed objectives are due. In any case, the minimum amount due is the amount that would be equivalent to completion of the first objective.
CMCS Initiated termination
In exceptional circumstances, where CMCS considers a contract was initiated with negligence or in bad faith. A contract might be terminated by CMCS. In this case, all payments will be frozen and no further transactions or refunds will take place.
5.3 Dispute resolution
In the remote case where the client and CMCS would have a dispute regarding the agreed upon terms of a contract, execution and payments will be on hold until an agreement can be reached.
5.4 Grace period
We require 2 weeks from contract termination before considering any offer made against the client.
6. SPECIAL CONSIDERATIONS
6.1 Confidentiality
Operational security options
- Force Projection - We will use fleet carriers for maximum effect and take extra steps to project force
- Overt - We will use fleet carriers for maximum effect
- Discreet - Ships only
- Covert - Extra steps to avoid detection, extra cost
- Force Projection - Use of system chat
- Request only - We will answer to inquiries about the client and may put both parties in contact
- Silent - We will not disclose any details other than the fact that we are under contract
As per 1.3, non-standard operations are within CMCS's capabilities. We will do our best to agree on objectives that are tailored to a client's unique situation. Those will be negotiated on a case by case basis. In complex cases, CMCS might request to take full control of a contracted operation.
7. COLLATERAL CONSIDERATIONS
7.1 Scope
This section applies to the target of a contract, their coalition members, proxies and mediators.
7.2 Proxies
CMCS may use proxies for a contract, however we will do our best to respect the sovereignty of said proxies and minimize any impact on their BGS.
7.3 Target
If you are the Target of a contract under execution, CMCS will not entertain counter-offers. However, we encourage you to contact us and join our Discord Server where you will be granted Diplomat access. We will engage the discussion on a case by case basis and respond in accordance to our contractual obligations.
You have the right to self-defense. CMCS assumes the risk of working under contract which might include the use of deadly force against our ships. While we may respond in kind during a contract, we are professionals and can assure you CMCS will not hold any animosity once contractual obligations are completed.
7.4 Mediation
As long as our contractual ROEs allow it, CMCS will enable both client and target parties to contact each other for diplomacy or mediation. CMCS will however not act as a mediator unless specifically tasked to do so by the client.
8. DEFINITIONS
- Client Organization or individual with which CMCS has an active contract
- Faction Unless specified, this includes both NPC Factions and Player-Managed-Factions (PMF)
- Target The target of a contract. This is a blanket term and could represent a faction, one or more systems, a squadron, any other type of entity or nothing specific
- Proxies Factions, Assets and Systems which are interacted with, but which are not the Target
